Explanatory Notes

The New York State Library prepared the library aid charts in this document in order to project estimated aid payments of 2008-2009 State aid for libraries.

Chapter 496 of the Laws of 2008, which passed during an extraordinary session in August 2008, enacted a special provision further reducing estimated 2008-2009 library aid payments by an additional .88%. This reduction is applied across-the-board to all library programs in Education Law with the exception of the State Library's Talking Book and Braille Library and the State Library's Conservation / Preservation Statutory Grant, which were reduced 10% by the Executive.

Chapter 57 of the Laws of 2008 enacted a special provision reducing estimated 2008-2009 Statutory library aid payment by 2%. In addition, a new hold harmless provision provides that no library, library system or library program will receive less than 98% of the State aid it received in 2001-2002. Chapter 57 of the Laws of 2008 also provides one-time supplementary formula funding for library systems for 2008-2009.

Library aid is allocated based on formulas in Education Law. Some aid formulas include per capita or per student factors. Therefore, the estimated Education Law amount for 2008-2009 may vary from what would be anticipated based on last year's figures.

Education Law, as amended by Chapter 57 of the Laws of 2006, provides that each library aid recipient will be funded based on the formulas in Education Law, using the 2000 census, with a hold harmless provision for the 1990 census. No library or library system will receive less State aid than was received under the 1990 census.

In addition to Chapter 53 of the Laws of 2008, which moves NYSL TBBL and C/P to State Operations, the library aid charts also include $350,000 directly appropriated to the four SUNY Centers for the conservation/preservation of library materials.

These charts do not include the one-time $14 million in Capital Funds provided for public library construction for 2008-2009.
